Childcare benefit as a freelancer: hours, income and clawbacks
Written by Ilias Aarrass6 min read · Published on · Last reviewed on
In short
As a freelancer you get childcare benefit on at most 230 childcare hours per child per month; how many hours you work does not matter, and your estimated profit sets the amount per hour.
- You do have to work, study or follow a route into work that month; there is no minimum number of hours.
- The maximum hourly rate in 2026 is € 11.23 for day care, € 9.98 for out-of-school care and € 8.49 for childminder care.
- Adjust your income estimate as soon as your year changes course; otherwise a clawback follows that can run into thousands.
- Childcare costs are private spending and not deductible from your profit; you can claim up to three months back.
For employed parents childcare benefit is fairly straightforward: the contract states how many hours you work and the annual statement states what you earn. As an entrepreneur you have neither. Your hours follow from your own records and your income is a profit you only know precisely after year-end. That does not make the benefit a problem, but it is something to review deliberately twice a year. This article explains how many childcare hours are covered, how to report your income and how to avoid a clawback in the autumn.
How many childcare hours are covered
Since 2023 the number of childcare hours no longer depends on the hours of the parent who works least. You receive benefit on at most 230 childcare hours per month per child, regardless of how many hours you work. You do have to work, study or follow a route into work in that month. If you use fewer hours in a month, you can still use them later in the same calendar year.
There is no minimum number of hours, but you must be able to show that you do work as an entrepreneur. For that, all hours spent on your business count, not just the hours you invoice. Administration, acquisition, writing quotes, maintaining your website and training all belong there. That is the same broad definition as the 1,225 hour hours criterion, and precisely the reason to record your hours consistently: one record serves two purposes.
Worked example: an hourly rate above the maximum
- The nursery's hourly rate
- € 11.95 per hour
- Maximum hourly rate for day care 2026
- € 11.23 per hour
- Difference you pay yourself
- € 0.72 per hour
- Hours purchased
- 24 hours a week, about 104 hours a month
- Outcome
- about € 75 a month on top of your own contribution
Result: You never get that difference reimbursed, however low your income. So when choosing a provider, always ask for the hourly rate and compare it with the maximum.
Reporting your income when you do not know it yet
The amount of your benefit depends on the combined assessment income. For you that is your profit after entrepreneur deductions and the SME profit exemption, exactly as it ends up in your income tax return. When applying you give an estimate, and on that basis you receive a monthly advance. After year-end the benefit is finalised using your actual figures.
That is where the trap lies. Estimate too low and you receive too much for months on end, followed by a clawback that can run into thousands. Estimate too high and you are effectively lending money to the tax authorities. The solution is simple but takes discipline: adjust your estimate as soon as you notice the year running differently than expected, for example halfway through the year and again in November.
- Review your expected annual profit twice a year and adjust your estimate if needed.
- Report it if you stop working or pause for a while: your entitlement to care hours then changes.
- Report a change in household situation or childcare provider straight away.
- Keep the childcare annual statement and compare it with the hours you received benefit for.
- Set aside a buffer for a possible repayment, just as for your tax reserve.
Conditions where it goes wrong in practice
Besides hours and income there are conditions on the care itself. The provider must be listed in the national childcare register and you need a written agreement. Care by family members without registration gives no entitlement. You also pay the invoices yourself, by bank transfer; paying cash or having someone else pay causes problems in checks.
Also note the application deadline: you can claim up to three months back, counted from the month care started. Apply later and the earlier months are lost for good. And keep an eye on the maximum hourly rate: if your provider charges more than the maximum, you pay that difference in full yourself. In 2026 that maximum is € 11.23 an hour for day care, € 9.98 for out-of-school care and € 8.49 for childminder care.
Are childcare costs deductible from your profit?
No. Childcare is a private expense, even if you could not work without it. If you pay the invoices from your business account, you record that as a private withdrawal and not as a cost. The support runs entirely through the benefit, not through your profit.
What does help is reversing the order: the lower your taxable profit, the higher your benefit. Investments, your buffer policy and the timing of your invoicing all influence your assessment income, see steering profit around year-end. Do not overdo it: lower profit also means less income, and benefits never make up the whole difference.
Frequently asked questions
Do I need to be able to prove my hours?
Yes. In a check the tax authorities ask for hour records or documents showing your activities: diaries, invoices, quotes and correspondence. A list drawn up afterwards without substantiation rarely convinces.
I am a single entrepreneur. Am I entitled to benefit?
Yes. There need not be a second working parent; the requirement that both parents work only applies if you have a benefit partner. The maximum of 230 hours per child per month applies here too.
What if my profit turns out much higher than estimated?
Adjust your estimate as soon as possible. The advance is then lowered immediately and you limit the clawback. Wait for the final calculation and the whole amount arrives at once, usually more than a year later.
Do I also get benefit for a day I am not working?
Yes. Since 2023 you no longer have to link your childcare hours to your working days. If you work in that month, all purchased hours count towards the maximum of 230 hours per child per month.
